1. Introduction

These Terms and Conditions govern the use of SpatialWorks Inspections, including the Quick Inspect service, website, application, reports, uploads, Algorithm-assisted analysis and related services provided by SpatialWorks Consulting.

2. Acceptance of terms

By registering for, accessing or using SpatialWorks Inspections, you agree to these terms. If you do not agree, you should not use the service.

3. Service description

SpatialWorks Inspections allows users to create inspections, upload inspection photos, generate Algorithm-assisted defect drafts, review and approve findings, and create PDF inspection reports.

4. User accounts

You are responsible for keeping your login details secure.
You must provide accurate account and inspection information.
You must not allow unauthorised users to access your account.
SpatialWorks Consulting may suspend access where misuse, fraud, non-payment or security risk is suspected.

5. Inspection data and uploaded content

You remain responsible for the accuracy, ownership and legality of photos, notes, asset information and other content uploaded to the service. You confirm that you have the necessary rights or permission to upload and process this content.

6. Algorithm-assisted findings

The algorithm-assisted analysis is provided as an assistant tool and may produce incomplete, incorrect or uncertain findings. Algorithm-assisted findings must be reviewed by a competent person before being accepted, used for repairs, sent to clients, or relied on for safety, compliance or engineering decisions.

7. Professional review and engineer sign-off

Unless expressly stated in writing, reports generated by the system do not constitute professional engineering certification, structural certification or statutory compliance certification. Professional engineer sign-off, where offered, is a separate review process and may require additional information, site verification and fees.

8. Payments and access

Some services may require once-off payment, subscription payment or annual payment before analysis or report generation is unlocked.
Fees may change from time to time.
Access to paid functionality may be restricted if payment is incomplete, reversed, overdue or disputed.
Refunds, where applicable, will be handled according to the payment terms agreed at purchase.

9. Report limitations

Reports are based on information available at the time of assessment, including uploaded photographs and user-provided details. Hidden defects, inaccessible areas, internal deterioration and structural capacity verification are excluded unless specifically assessed by a competent professional.

10. Prohibited use

You may not use the service for unlawful, fraudulent or harmful purposes.
You may not upload malicious files, offensive material or content that infringes third-party rights.
You may not attempt to bypass payment controls, security controls or access restrictions.
You may not reverse engineer, copy or resell the software without written permission.

11. Availability

SpatialWorks Consulting aims to keep the service available, but does not guarantee uninterrupted access. Maintenance, hosting issues, internet failures, third-party API downtime and other technical issues may affect availability.

12. Limitation of liability

To the maximum extent permitted by law, SpatialWorks Consulting will not be liable for indirect losses, consequential losses, loss of profit, loss of data, business interruption, or decisions made solely on unreviewed algorithm-assisted outputs.

13. Intellectual property

The SpatialWorks Inspections software, branding, layouts, workflow, report templates and related intellectual property remain owned by SpatialWorks Consulting or its licensors. User-uploaded content remains the responsibility of the user or relevant rights holder.

14. Changes to these terms

SpatialWorks Consulting may update these terms from time to time. Continued use of the service after updates means you accept the revised terms.
